LUMA·NOVA Stellar Friends Terms & Conditions 

By participating in LUMA·NOVA’s Stellar Friends referral program, you are consenting to our terms and conditions as outlined below.

 The following terms also apply to you: LUMA·NOVA Privacy Policy and General Terms

GENERAL TERMS OF THE STELLAR FRIENDS PROGRAM

  • Commission earned is 20% of subscription price excluding GST
  • Commission is earned on monthly and annual subscriptions
  • Commission earned is recurring, for as long as both subscriptions remain active and current (end-customers and yours)
  • Commissions are paid on the 15th of each month, for sales that are at least 45 days old (for example, a June 15th payout will include all referral sales made on or before 1st May).
  • The minimum required accrued commission for a payout is $50AUD.
  • Commission payouts are done via PayPayal, therefore all referrers must maintain a valid PayPal account for the duration of their participation in this program
  • Commission reports are available from the referrers’ affiliate portal
  • If you have an ABN, an RCTI (Recipient Created Tax Invoice) will be supplied at the time of payout
  • The referrer understands and agrees that it is their responsibility to seek professional advice on any income and taxation obligations incurred as a result of earning commission
  • The referrer can opt out of the Stellar Friends referral program at any time
  • Referrers agree to disclose to potential new subscribers that the referrer will earn commission on the sale using their link (legal requirement under the Fair Trading Act)

 

CONDITIONS OF THE STELLAR FRIENDS REFERRAL PROGRAM

OVERVIEW

The terms “we,” “us,” and “our” refer to Jo-Anne Worsfold trading as LUMA·NOVA. The term the “Site” refers to lumanova.com.au. The terms “user”, “you,” and “your” refer to site visitors, customers, referrers, subscribers and any other users of the site.

SERVICE

LUMA·NOVA Stellar Friends is a referral program for current subscribers of Stellar Journeys, whereby participants in the program (Referrers) earn commission on new and recurring referrals (the “Service”).

Participation in and use of this program, including all materials presented herein and all online services provided by LUMA·NOVA and Jo-Anne Worsfold, is subject to the following Terms and Conditions. These Terms and Conditions apply to all site visitors, customers, referrers, subscribers, and all other users of the site. By using the Site or Service, you agree to these Terms and Conditions, without modification, and acknowledge reading them.

Parties agree that the Service is in the nature of spirituality. The scope of services provided by LUMA·NOVA according to this Agreement are limited to those listed on lumanova.com.au website. LUMA·NOVA reserves the right to substitute services equal to or comparable to the services listed if the need arises, without prior notice.

USE OF THE SITE AND SERVICE

To access or use the Stellar Friends referral program you must be 18 years of age or older and have the requisite power and authority to enter into these Terms and Conditions. Children under the age of 18 are prohibited from using this Service. Information provided on the Site and in the Service related to spirituality and other information are subject to change. LUMA·NOVA makes no representation or warranty that the information provided, regardless of its source (the “Content”), is accurate, complete, reliable, current, or error-free. LUMA·NOVA disclaims all liability for any inaccuracy, error, or incompleteness in the Content.

REFERRAL MANAGEMENT SYSTEM

The referral relationship through Stellar Friends is securely managed through the LUMA·NOVA Website using SureCart.

Referral links are tracked by cookies on the end-user’s (whomever the referring subscriber shares the link with) internet browser for up to 30 days.

End-user must have support for browser cookies for the tracking to work effectively.

We are not responsible for payment commissions where the Referral link has not been tracked for any reason including where the end-user browser cookies are not working to provide the information required to confirm a successful conversion using the Referral link provided.

COMMISSIONS

As a Referrer, you will receive 20% of the total sale price (excl GST) as a commission for all subscriptions to Stellar Journeys placed through your unique referral link.

You will receive recurring commission on all recurring subscriptions, for as long as both subscriptions remain current (theirs and yours).

Where the client you refer under this Agreement chooses to opt in to any additional services including but not limited to private 1:1 sessions, Stellar Mentoring, or Stellar Retreats, the Client will be directed to a different booking process which is expressly excluded from this Agreement.

All payment and all references to payments or money in this Agreement are in Australian dollars.

We may change this commission rate at any time, including increasing the commission percentage temporarily for promotional periods, from time to time.

At the conclusion of any promotional period, the rate will return to the regular commission percentage under this Agreement.

We reserve the right to disqualify commissions earned through fraudulent, illegal, or overly aggressive, questionable sales or marketing methods.

In order to generate a commission, the End-User must:

  • Use your properly coded affiliate link (it is your responsibility to ensure that the correct link is provided to the client) AND
  • Pay for a monthly or annual Stellar Journeys subscription through the LUMA·NOVA Website;
  • (Orders that are refunded for any reason whatsoever do not attract a commission payment.)

PAYMENTS

Commission payments for sales that are at least 45 days old will be made to you on the 15th of each month through PayPal (for example, a June 15th payout will include all referral sales made on or before 1st May).

Minimum required accrued commission for a payout is $50AUD.

It is your responsibility to notify us of any changes to your contact details, email address or PayPal account.

The subscription price charged to subscribers includes GST.

We will be responsible for paying the GST on the whole purchase price charged to the subscriber.

You are responsible for meeting all of your tax obligations in respect of your referral income, including paying GST out of your commission if you have an ABN and are registered to do so. Your 20% commission will be calculated on the subscription price LESS GST.

AUSTRALIAN CONSUMER LAW

LUMA·NOVA’s products and services are offered in compliance with Australian Consumer Law.

You agree to disclose to potential new subscribers of Stellar Journeys that you will earn commission on the sale using your link.

LAWFUL PURPOSES

You may use the Site and Service for lawful purposes only. You agree to be financially responsible for all purchases made by you or someone acting on your behalf through the Site. You agree to use the service and any subsequent purchases or services or products through the Site or Service for legitimate, non-commercial purposes only. You shall not post or transmit through the Site any material which violates or infringes the rights of others, or which is threatening, abusive, defamatory, libellous, invasive of privacy or publicity rights, vulgar, obscene, profane, or otherwise objectionable, contains injurious formulas, recipes, or instructions, which encourages conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any law.

TERMINATION

Either you or we may end this Agreement AT ANY TIME, with or without cause, by giving the other party written notice. Written notice can be in the form of mail, email or fax. In addition, this Agreement will terminate immediately upon any breach of this Agreement by you

REFUSAL OF SERVICE

The Services are offered subject to our acceptance of your order or requests. We reserve the right to refuse service to any order, person or entity, without the obligation to assign reason for doing so. No order is deemed accepted by us until payment has been processed. We may at any time change or discontinue any aspect or feature of the Site or Service, subject to us fulfilling our previous responsibilities to you based on acceptance of your payment.

ACCOUNT CREATION

In order to use the Service, you will be required to provide information about yourself including your name, email address, username and password, and other personal information. You agree that any registration information you give to LUMA·NOVA will always be accurate, correct, and up to date. You must not impersonate someone else or provide account information or an email address other than your own. Your account must not be used for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any laws in your jurisdiction.

PROGRAM ENROLMENT CONFIRMATION

We will email you to discuss your Expression of Interest in the Stellar Friends program further.

If/when you are accepted into the program, you will be emailed confirmation.

In the event that there is an error in this email confirmation, or you do not receive it, it is your responsibility to inform us as soon as possible.

DURATION OF AGREEMENT

Once confirmed, we will provide you access to the enrolled program. You agree and understand that access to the Service may at times be influenced and affected by third parties that we use to provide the Service (web hosting, membership site plugins, etc.). You agree and understand that no breach of contract action may be initiated against LUMA·NOVA when there are reasonable delays in the access of the Service.

LUMA·NOVA reserves the right to terminate the Service, and or access to certain features of the Service, with or without prior notice to you. We will make reasonable efforts to provide notice but is not required to do so under the terms of this agreement.

CANCELLATIONS

You may cancel your enrolment in the program at any time via your member dashboard or you can email info@lumanova.com.au

Once you cancel you will receive final payout on the 15th of the following month and you will then no longer have access to the program, including the resources.

It is entirely your responsibility to ensure that you cancel your enrolment in good time should you no longer require the Service.

OUR INTELLECTUAL PROPERTY

The Site and Service contain intellectual property owned by LUMA·NOVA, including trademarks, copyrights, proprietary information, and other intellectual property. LUMA·NOVA’s copyrighted and original materials are provided to you as part of the Service for your individual use only and a single-user license. All intellectual property, including LUMA·NOVA’s copyrighted materials shall remain the sole property of LUMA·NOVA. No license to sell or distribute our materials is granted or implied.

You may not modify, publish, transmit, participate in the transfer or sale of, create derivative works from, distribute, display, reproduce or perform, or in any way exploit in any format whatsoever any of the Site or Service Content or intellectual property, in whole or in part, without our prior written consent. This includes but is not limited to sharing material with others, posting excerpts of material on any social media, blogging about the material, or in any other way that would reasonably appear to share the Site or Service’s information with a non-subscriber. We reserve the right to immediately remove you from the Service, without refund, if you are caught violating this intellectual property policy.

CHANGED TERMS

We may at any time amend these Terms and Conditions. Such amendments are effective immediately upon notice to you by us posting the new Terms and Conditions on this Site. Any use of the Site or Service by you after being notified means you accept these amendments. We reserve the right to update any portion of our Site and Service, including these Terms and Conditions, at any time. We will post the most recent versions to the Site and list the effective dates on the pages of our Terms and Conditions.

THIRD PARTY RESOURCES

The Site and the Service may contain links to third party websites and resources. You acknowledge and agree that we are not responsible or liable for the availability, accuracy, content, or policies of third party websites or resources. Links to such websites or resources do not imply any endorsement by or affiliation with LUMA·NOVA. You acknowledge sole responsibility for and assume all risk arising from your use of any such websites or resources.

SOCIAL MEDIA DISCLAIMER

When you use LUMA·NOVA’s social media pages – including membership groups and pages, you are using an external site and are therefore bound by the terms and conditions of use of that site.  We encourage you to review the legal policies of that site for further information.  LUMA·NOVA does not endorse, and is not accountable for any views expressed by third parties using that site.
